Checklist for a Preliminary Patent Search

It takes two hours to begin a preliminary patent search. Please call to make an appointment before visiting the Patent & Trademark Library (405) 744-6546.

You may also want to visit the Edmon Low Library's Science & Engineering Department (1st floor) to see if your invention idea has been previously disclosed in a scientific journal, technical document, or trade publication.

  1. Determine the initial classifications using keywords found in the Index to the U.S. Patent Classification System. The Index is also available online at http://www.uspto.gov/go/classification/

  2. Locate initial classifications in the Manual of Classification. Narrow list to several applicable class/subclasses. The classes are also available online at http://www.uspto.gov/go/classification/

  3. Read the definitions if necessary to establish the scope of the subclasses relevant to the search. The definitions include important search notes. The definitions are available online at http://www.uspto.gov/go/classification/

  4. To view patents online by class/subclass, search lists of patents by selecting the red "P" next to the subclasses. Click on the patent number or title to see the text of the patent. Click on the Images button to view the full-text (including images) of the patent. The AlternaTiff plug-in must be loaded on your workstation in order to view these files. Note any patents which are very close in function or design to your invention.

  5. If you are having difficulty identifying a class/subclass, you may do a keyword search using the USPTO's Advanced Search page to try to find a patent that is similar to yours. Search using key terms that describe your concept and combine them using the word 'and.' Example: cat and fiddle. Searches may be limited to the Abstract by placing abst/ in front of the search term. Example: abst/cat and abst/fiddle. If you find a patent that is similar to your concept, check the 'Current U.S. Class' for this patent. Then go back and follow steps 1.-4. above.

  6. Check References cited in closely related patent documents. Patent Applications may also be searched by class/subclass using the Advanced Search page.
